Terms of Service

These terms govern your use of the Wheel Scout app and website. By creating an account or using the service, you agree to them.

The most important thing: Wheel Scout is a research tool, not an appraisal, inspection, or guarantee. Deal scores, price estimates, and risk flags are informational aids generated from public listing data. Always inspect a vehicle in person and verify its title and history before buying.

1. What Wheel Scout does

Wheel Scout finds publicly available private-party vehicle listings near you, scores them against estimated market value, and flags potential risks such as branded titles, disclosed mechanical problems, and listings that appear to be posted by dealers. Optional paid vehicle-history reports are sourced from third parties.

2. No warranty on scores, prices, or flags

Scores, fair-value estimates, mileage figures, title statuses, and risk flags are derived from third-party listing text and data sources that may be incomplete, outdated, or inaccurate. We do not inspect vehicles and we do not verify seller claims. Wheel Scout makes no warranty that any listing, price, score, or report is accurate or complete, and does not guarantee any outcome from a vehicle purchase. You are solely responsible for your buying decisions.

3. Vehicle history reports

Odometer and salvage checks use NMVTIS-sourced data through our provider; Carfax reports are produced by Carfax. Those reports reflect only what has been reported to those systems and may not include every event in a vehicle's history. Reports are delivered for your personal use and may not be resold or redistributed.

We grant you a limited, personal, non-exclusive, non-transferable, revocable license to use the Wheel Scout app and website for your own, non-commercial use, subject to these Terms. Wheel Scout LLC keeps all rights, title, and interest in the software, design, data, and content — a membership buys access, not ownership. Except as these Terms allow, you may not copy, modify, distribute, sell, lease, or reverse-engineer the app or any part of it.

If you use Wheel Scout through the Apple App Store: these Terms are an agreement between you and Wheel Scout LLC only — not Apple. Apple has no obligation to provide maintenance or support for the app and is not responsible for it or for any claims relating to it. To the extent required, Apple and its subsidiaries are third-party beneficiaries of this section and may enforce it against you. Your use of the app must also comply with the Apple Media Services Terms and Conditions.

We may suspend or terminate accounts that violate these terms or that place abnormal load on the service.

8. Third-party listings and trademarks

Vehicle listings are created and hosted by third parties. Wheel Scout does not control that content, does not endorse any listing or seller, and is not a party to any transaction between a buyer and a seller. Wheel Scout is not affiliated with, endorsed by, or sponsored by Facebook, Meta, Carfax, or Apple. All trademarks belong to their respective owners.

9. Beta software

During the beta period the service is provided as-is for testing. Features may change or break, data may be reset, and availability is not guaranteed.

10. Limitation of liability

To the maximum extent permitted by law, Wheel Scout and its operator are not liable for indirect, incidental, special, consequential, or punitive damages, or for any loss arising from a vehicle purchase, sale, or negotiation. Our total liability for any claim relating to the service is limited to the amount you paid Wheel Scout in the twelve months before the claim.

11. Disputes: talk to us first, then individual arbitration

Step one — tell us. Before starting any formal proceeding, email branson@wheelscoutapp.com with a description of the problem. Most issues are fixed in days. We both agree to try in good faith to resolve any dispute informally for 30 days before taking any further step.

Step two — binding individual arbitration. If we can't work it out, you and Wheel Scout agree that any dispute arising out of these terms or the service will be resolved by binding arbitration on an individual basis, administered by the American Arbitration Association under its Consumer Arbitration Rules, rather than in court. The arbitration will be held in the United States county where you live, or conducted remotely. Each side bears its own attorneys' fees unless the arbitrator awards otherwise under applicable law.

Class-action waiver. Disputes will be arbitrated only on an individual basis. Neither of us may participate in a class action, class-wide arbitration, or representative proceeding against the other.

What this doesn't cover. Either of us may still bring an individual claim in small-claims court, and either of us may seek injunctive relief in court for infringement or misuse of intellectual property.

Your right to opt out. You may reject this arbitration agreement (and the class-action waiver) by emailing branson@wheelscoutapp.com with the subject "Arbitration opt-out" within 30 days of first creating your account. Opting out does not affect any other part of these terms.

12. Changes and termination

We may update these terms; material changes will be reflected by the date above and, where appropriate, announced in the app. You may stop using the service and delete your account at any time.

13. Governing law

These terms are governed by the laws of the State of California, without regard to conflict-of-law rules.
